Welcome to Floratica! These Terms and Conditions govern your use of the Floratica mobile application (“the App”). By accessing or using the App, you agree to be bound by these terms.

1. User Data and Privacy

• Data Collection: The App collects standard analytics information through Firebase Analytics to enhance user experience. This data is used for internal purposes only.

• Data Privacy and Protection: User subscription data is managed by RevenueCat and Apple's In-App Purchase (IAP) services, ensuring secure and compliant data handling.

• Third-Party Sharing: The App does not share any user data with third parties.

2. Content Ownership and Use

• Ownership: Users retain ownership of all content, including photos of plants, uploaded to the App.

• Usage: The App uses the photos solely for the purpose of plant identification and does not utilize them for any other purposes, including data training or promotional materials.

3. Subscription and Payment Terms

• Subscription Plans: The App offers monthly and annual subscription options. Subscriptions can be cancelled at any time.

• Payment Processing: Payments are processed by Apple as part of their standard iOS app services.

• Refunds and Cancellations: Refund and cancellation policies are subject to Apple's standard terms for In-App Purchases.

4. Plant Identification and Chat Feature

• The App allows users to identify plants using photos and engage in chat interactions using the ChatGPT API. This feature is designed for informational purposes only.

5. Limitations of Use

• The App should not be used for critical or emergency plant identification needs. The accuracy of plant identification is not guaranteed.

6. Liability and Disclaimer

• Floratica provides plant identification services “as is” and does not make any express or implied warranties about the accuracy or reliability of the service. The App is not liable for any decisions made based on the information provided.

7. Changes to Terms and Conditions

• Floratica reserves the right to modify these Terms and Conditions at any time. Users will be notified of any changes through the App or via email.

8. Governing Law

• These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Mexican States. Any dispute, controversy, or claim arising out of or in relation to these Terms and Conditions, including the validity, invalidity, breach, or termination thereof, shall be resolved exclusively by the competent courts in Quintana Roo.

• Users accessing the "Floratica" service acknowledge that the jurisdiction and laws of the United Mexican States govern any matters related to the use of the service and the application. This Governing Law agreement ensures that both "Floratica" and its users understand and agree that any legal dispute will be handled within the Mexican legal framework.
